COOPERATIVE DPT TO TAKE LEGAL ACTION
The Department
of Co-operatives has warned that it could institute court action against any
person or entity that uses the word ‘Co-operative’ for commercial purposes
without authorization by the sector Minister.
This is because using the name
without permission is a breach of the Co-operative Societies’ Decree, NLCD 252
of 1968 that states that ‘No person other than a registered Co-operative
society shall without the prior approval of the Minister responsible for
Co-operative affairs carry on any trade or business under any name or title of
which the word ‘Co-operative’ is part’.
The Ashanti Regional Director of the
Department of Co-operatives, Charles Kwaku Boateng gave the warning in Kumasi.
He was receiving a donation of building materials including roofing sheets in
addition to cash from the TEK Co-operative Credit Union for the renovation of
the Regional offices of the Department of Co-operatives which is currently in a
deplorable state.
Mr. Boateng observed with concern that some business people
are flouting the law by abusing the Co-operatives for their own gains, mainly
due to ignorance of the law.
He noted also that instead of seeking directions
from the Department of Co-operatives on the legal processes, many individuals
and enterprises are forming Co-operatives without considering the legal
implications.
Mr. Boateng asked Ghanaian entrepreneurs to adopt the
co-operative concept of doing business, by forming productive co-operative
ventures to boost their business activities.
