NDC OPTS FOR OUT-OF-COURT SETTLEMENT

Kumasi High Court, presided over by Justice Jacob Boon, has granted the NDC and
its aggrieved member, Linus Njonolah their request for an out-of-court
settlement of their disagreements over a directive by the National Executive of
the party restraining any member who has never held any position in the party,
or held any office in governments formed by the party, from contesting in the ongoing
regional and national elections. Justice Boon told the two feuding parties to
return to the Court at a later date with the settlement agreement for the
substantive case to be struck out.
The Court’s decision followed an application
by the legal team of the NDC for an out-of-court settlement of the matter which
was consented to by the Counsel for complainant, Mr. Njonolah. Mr. Njonolah’s
Counsel told the Court that once the national executives of the NDC have agreed
to back-down on its earlier directive, his client is ready for an amicable
settlement of the disagreement.
Later in an interview with journalists, Mr.
Njonolah described the decision as a victory of democracy over dictatorship. He
urged progressive forces in the NDC to rise up to change the ineffective
leadership of the party saying that he will soon launch a campaign for a change
of the leadership of the party which he described as ineffective.
On his part,
the General Secretary of the NDC, Johnson Asiedu Nketiah described the court’s
decision as a victory for democracy adding that the law must always reign
supreme in a democracy.
Mr. Asiedu Nketiah expressed satisfaction for the decision
particularly because it took an ordinary member to use the law court to
challenge a decision of the National Executive Committee saying that the party
considers the case very important.
He explained that the national executives
took the decision for an out-of-court settlement after acknowledging the fact
that the new election guideline does not have a legal basis within the NDC’s
Constitution for which reason, it has been reversed.
Mr. Asiedu Nketiah assured
the members that NDC will continue to consider the interest of them all without
any form of discrimination.
